🔍 What data do we collect?

We rely on the lawful basis of legitimate interest to process publicly available planning application data, as it is necessary for providing our service to professionals involved in the planning process. There is also non-personally-identifiable information such as site plans.

We also collect email addresses of users as part of the login process.

🧭 How do we collect your data?

We collect publicly available information from publicly available websites such as councils and An Coimisiún Pleanála.

By logging in you provide your own email address.

✅ How will we use your data?

Plan Assured will aggregate, filter & distribute publicly available data to people involved in the planning process who already have legitimate interest in it as part of their work, such as planning consultants, engineers & architects.

We process email addresses under the lawful basis of contractual necessity and user consent. We will not share your email address.

Plan Assured is a paid product. Your personal data is not used for advertising or resold to third parties.

Plan Assured collects your data so that we can:

  • Optimise the planning process by sending notifications
  • Provide search facilities on top of pre-existing data
  • Manage your account

🔐 How do we store your data?

Plan Assured staff will never share your data with a 3rd party except as required for business operations (e.g. sending an email to you via an email-sending service) or if compelled to do so by law.

Plan Assured securely stores your data in Google's Firebase.

Encryption, obfuscation & deletion

All data is encrypted at rest by Firebase and we also encrypt in transit. Unencrypted data will be visible to you, as an individual user, in and stored in your browser; it is limited to what you can see for yourself on your screen plus closely related information.

Data retention periods

Plan Assured will keep data of different types for different periods of time:

  • Publicly available information drawn from councils & An Coimisiún Pleanála for an indefinite period.
  • We retain login data for a limited period following account closure.

Data locality

We instruct our hosting provider to process and keep our data on servers located in the Republic of Ireland where possible and within the EU in other cases.

When you view data in a client such as your web browser then it physically exists on the computer where you have chosen to run that program. Similarly, Plan Assured staff will view information on their computers with the purposes of providing and enhancing the services that you receive, and the location of staff is habitually but not limited to the Republic of Ireland.

🤝 Who processes your data?

Plan Assured uses other web services to perform some functions, according their standard terms & conditions. We believe that they are operated in good faith and that their standard data processing agreements are sufficient for the data protection of our customers and their customers. You may check their terms and if you are not satisfied then you can exercise your data protection rights and/or cancel your subscription. Plan Assured is a data controller in relation to user login data.

By using Plan Assured you agree that we may use these services to process your data and may change this list at any time.

  • Sendgrid for sending and receiving emails

🛍️ Marketing

Plan Assured does not process your personal data for direct marketing purposes. We do not use profiling or behavioral tracking.

👤 What are your data protection rights?

Plan Assured would like to make sure you are fully aware of all of your data protection rights. Every user is entitled to the following:

  • The right to access – You have the right to request from Plan Assured copies of your personal data. We may charge you a small fee for this service.
  • The right to rectification – You have the right to request that Plan Assured correct any information you believe is inaccurate. You also have the right to request Plan Assured to complete the information you believe is incomplete.
  • The right to erasure – You have the right to request that Plan Assured erase your personal data, under certain conditions.
  • The right to restrict processing – You have the right to request that Plan Assured restrict the processing of your personal data, under certain conditions.
  • The right to object to processing – You have the right to object to Plan Assured’s processing of your personal data, under certain conditions.
  • The right to data portability – You have the right to request that Plan Assured transfer the data that we have collected to another organization, or directly to you, under certain conditions.

The Plan Assured product takes its instructions from you and you are responsible for what you instruct Plan Assured to do on your behalf. E.g. if you instruct Plan Assured to email a particular email address or address a person by a particular name then it will simply do so, and you are responsible for that instruction.

🤝 Planning Process Data

For planning application data, Plan Assured acts as a data processor or secondary user of information already made public by original data controllers, such as local councils or An Coimisiún Pleanála.

🛡️How to request a correction or deletion

Contact the relevant local council or An Coimisiún Pleanála. After they have corrected or deleted the data then Plan Assured will automatically discover the data's new state, take a copy, and store the updated copy containing the changes that you requested. No manual action is necessary inside Plan Assured.
